Terms and Conditions
General
These terms and conditions form the agreement between the property owner, Lisa Labate (also referred to as “I” or “me”), and the lead guest (“you”).
The lead guest is the person who makes the booking and payment. This person is responsible for ensuring that all members of their party adhere to these terms and conditions.
The property referred to in these terms and conditions is Number 19, situated at 19 Riviera Gardens, Leeds, LS7 3DW.
Bookings
All bookings must be paid in full at the time of booking. Online payments are processed securely via Stripe, a third-party payment processor. A booking is only confirmed once the payment has been successfully processed and funds are cleared. Until the payment is successfully completed, the dates remain open to other guests and the booking is not valid.
Cancellation by the lead guest
Cancellation of the booking by the lead guest should be made in writing and sent via email to:
Lisa Labate
To ensure receipt, I also require a secondary notification via text message to 07758943339. The cancellation is only effective once acknowledged in writing.
Commitment to Re-let: Upon receipt of a cancellation, I will immediately re-advertise the property in an attempt to re-let it for the period of the original booking.
Cancellation before 6 weeks: if cancellation happens 6 weeks before the booking, a full refund will be made, minus a £50 administration fee.
Cancellation under 6 weeks: If the property is successfully re-let for the entire period and at the same price as your original booking, you will be refunded the amount paid less a £50 administration fee.
Re-let at a Discount: If the property is re-let at a lower price (e.g., a last-minute discount), your refund will be the new rental amount received, less the £50 administration fee. You will remain liable for the difference between the original booking price and the new rental rate.
Partial Re-let: If I am only able to re-let part of your cancelled dates, you will be refunded the income from those specific dates only, less the £50 administration fee.
Unsuccessful Re-let: If you cancel within 6 weeks of your booking and I am unable to re-let the property for your cancelled dates, no refund will be due and you will remain liable for the full cost of the booking.
I strongly recommend you take out holiday cancellation insurance.
Cancellation by the Property Owner
I will ensure that the property is available for the contracted dates. In the unlikely event the property becomes unavailable and I have to cancel the booking, I will make every reasonable effort to find the lead guest suitable alternative accommodation. If suitable alternative accommodation cannot be found, the lead guest will be entitled to a full refund. I will only be liable to return all sums received. No compensation or consequential losses will be paid.
Miscellaneous
Whilst every care is taken to provide a true and accurate description of the property, over time, alterations are made and some things do change. The lead guest accepts that no refunds are available for such discrepancies.
The property owner reserves the right to enter the property without notice at any time in the event of an emergency or at a reasonable time for urgent remedial repair work.
House Manual & Specific Rules
In making a booking, the lead guest commits to adhering to the House Rules provided separately in the House Manual (e.g. shoe-free policy, not eating in bedrooms, kitchen and pet hygiene).
Failure to follow the House Rules may result in additional cleaning or maintenance charges being deducted from the breakage deposit.
Guest Conduct & Right of Eviction
The property owner reserves the right to terminate the booking and ask the lead guest and their party to leave the property immediately, without refund, if their behaviour is considered unreasonable or if there is a breach of these terms and conditions.
This includes, but is not limited to:
Number of Guests
The maximum number of people permitted to stay at the property is stated in the property description. Only those people named on the booking form are permitted to stay overnight. Unregistered overnight guests are not permitted and will be treated as a breach of these terms and conditions. If more people than agreed are found to be staying at the property, the lead guest and their party may be required to leave immediately without refund.
Daytime visitors are permitted only with prior notice to the property owner.
Sub-letting or assignation of the booking is strictly prohibited.
Pets
Only dogs are permitted, subject to the property owner’s prior agreement. All dogs must be house trained and the number and breed must match exactly what was agreed at the time of booking (maximum of 2 dogs).
Dogs must not be left unaccompanied in the property or garden at any time and must not be allowed on the beds or furniture. All dog waste in the garden must be picked up immediately, double-bagged, and disposed of immediately.
The lead guest is liable for all damage caused by their dog and a charge will be made for any additional cleaning required. The property owner cannot be held responsible for any accident or injury to a pet during their stay.
The property owner reserves the right to refuse entry and cancel the booking without refund if any unapproved pet is brought to the property.
Arrival and Departure Time
The check-in time is from 15:00 on the day of arrival. The property must be vacated by 10:00 on the day of departure. Late departure will result in an additional charge being made. (£25 per hour or part thereof).
Information about keys and how to collect them will be provided prior to arrival. The code to the key box is sent on the day of arrival.
Liability
The property owner takes no responsibility for the personal possessions of the guests. Vehicles and possessions are left entirely at their owner’s risk.
Children must be supervised at all times.
Internet Usage
The lead guest is responsible for ensuring that all members of their party use the internet connection provided for lawful purposes only. Unlawful activities, including but not limited to illegal downloading, copyright infringement, or accessing offensive material, are strictly prohibited. The property owner will not be liable for any misuse of the service by the guests.
Cleaning
The lead guest is responsible for ensuring that the property is treated as their own home and left in a clean and tidy condition at the end of the stay. I retain the right to make an additional charge for cleaning if the property is not left in a similar condition to that in which it was found at the start of the stay.
Breakages
Any accidental damage or breakages should be reported prior to departure. The property owner retains the right to make an additional charge for damage and breakages. Minor breakages and reasonable wear and tear will not be charged for.
Any additional charges for cleaning or damage will be deducted from the breakage deposit in the first instance.
Noise and Respect for Neighbours
The property is in a residential area. Please respect the neighbours and ensure that quiet hours are observed between 9:30 pm and 8:00 am. Parties or disruptive events are strictly prohibited.
Electric Vehicles
The charging of electric vehicles from the domestic supply is not permitted. The closest charging station is on the Scott Hall Leisure Centre Car park, 2 minutes drive from the house.
Complaints
While every effort is made to ensure your stay runs smoothly, occasional issues may arise. In these circumstances, the property owner should be notified as soon as possible so that the issue can be addressed during the stay. I will make every reasonable effort to rectify any identified problems as soon as is reasonably possible.
Complaints raised after departure may not be considered if I was not given the opportunity to resolve the issue during the stay.
Return of Breakage Deposit
Any breakage deposit, minus any deductions, will be returned within 2 weeks of departure.
